This Trust Agreement governs the booking between the Customer (event requester) and the Event Planner (service provider) facilitated through SimiTolk.
1. Service Commitment: The Event Planner agrees to provide the agreed event services (including venue, setup, catering, decoration, and any other agreed services) on the specified date, time, and location. The Planner must deliver services matching the description provided during acceptance.
2. Payment Terms: The Customer agrees to pay the agreed budget amount as per the payment schedule. Advance payments are non-refundable after the event date unless the Planner fails to deliver services. Final payment is due on the event day.
3. Legal Action — Planner Fraud: If the Event Planner fails to deliver the agreed services without valid reason, provides materially false information about venue or capabilities, engages in financial fraud, or commits any deceptive practice, the Customer reserves the right to initiate legal proceedings under the Indian Contract Act, 1872, Consumer Protection Act, 2019, and applicable laws. SimiTolk will provide all transaction records and cooperate with the aggrieved party.
4. Legal Action — Customer Fraud: If the Customer provides false identity information, makes fraudulent payment chargebacks, cancels to cause deliberate financial harm, or engages in any deceptive practice against the Planner, the Event Planner reserves the right to initiate legal proceedings. SimiTolk will provide evidence and cooperate with law enforcement.
5. Cancellation Policy: Either party may cancel with 7 days' written notice through SimiTolk. Cancellation within 7 days of the event may result in forfeiture of advance payment. Cancellation on the event day results in full payment obligation unless force majeure (natural disaster, government order, etc.) applies.
6. Dispute Resolution: Any dispute must first be reported to SimiTolk's resolution center within 7 days. SimiTolk will mediate for up to 15 days. If unresolved, disputes shall be settled by arbitration in Pune, Maharashtra, India under the Arbitration and Conciliation Act, 1996.
7. SimiTolk's Role: SimiTolk acts as a platform connecting customers and event planners. While SimiTolk facilitates the booking and provides the Trust Agreement, the direct contractual relationship is between the Customer and the Planner. SimiTolk reserves the right to suspend accounts found engaging in fraud.
8. Data & Privacy: Both parties consent to SimiTolk storing event details, contact information, and transaction records for dispute resolution and service improvement. Personal data is handled per SimiTolk's Privacy Policy.
By submitting this form, you acknowledge that you have read, understood, and agree to the Trust Agreement Terms above. Both parties must digitally sign this agreement before the booking is confirmed.
